    Schmier: Benedict S., Kanonist, geboren im J. 1682 zu Grönenbach (bair. Schwaben), † zu Eldern (zu Ottobeuern im bair. Schwaben gehörig) am 28. Juni 1744. Nachdem er am 9. November 1700 bei den Benedictinern zu Ottobeuern das Ordensgelübde abgelegt, seine Studien vollendet und verschiedene Aemter im Ordenshause versehen hatte, wurde er 1713 Professor der Philosophie|in Salzburg, 1714 Dr. theol., 1715 Dr. iuris und Professor des kanonischen Rechts. 1721 Professor der Theologie. Diese Stellung vertauschte er 1733 mit der ihm vom Abte aufgetragenen des Superior zu Eldern. Er war vom Erzbischof von Salzburg zum Geistlichen, vom Fürstabt zu Kempten zum Geheimrath ernannt worden. Schriften: „Philosophia, quadripartita," 1716, 4°; „Fundamentum et vertex universi iuris canonici,“ eod. 4°; „Sacrosanctae ecclesiae in genere cum suis praerogativis tractatu iuridico circumornatae,“ cet. 1717, 4°; (Rechtsverhältnisse der Kirchen: Stiftung. Immunität. Veräußerung, Privilegien bezüglich der Verjährung u. s. w.); „Sacratissimus ordo episcoporum cum ecclesiis cathedralibus, canonicatibus et sacris officiis,“ 1718, fol. Liber I, decretal. Greg. IX. Lib: II, III, IV, V, 1719—23. 5 vol. fol. (Lib. V, zuerst 1718); „De potestate clavium in distribuendis ex thesauro ecclesiae indulgentiis ... cum annexo de jubileis tractatu," 1726, 1729, 4°; „De potestate clavium in concedendis jubileis universalibus tam ordinariis quam extraordinariis, nec non de facultatibus eorum accessoriis,“ 1729, 4°; „Potestas clavium fori interni cum virtute et sacros. poenitentiae“ cet. 1729, 4°, alle in Salzburg erschienen (über die Beichte: Spendung. Berechtigung dazu u. s. w.); „Sacra theologia scholastico- polemica- practica, tractatus viginti novem complectens“, Aug. Vindel. 1737, 3 T. fol. Sämmtliche Schriften wurden viel benutzt.
